User and Privacy Agreement

This is a temporary User and Privacy Agreement put in place until a more robust agreement can be made.

This User and Privacy Agreement describes how we collect and use your personal information in relation to De3ign2Lab’s websites, applications, products, services, events, and experiences that reference this Privacy Notice.

Payments

All payments are handled by a third-party (Stripe or PayPal). Please see their individual policies and agreements about your information. We do not personally store any credit card or identifying information in De3ign2Labs through these payment systems beyond a subscription id which is used to identify you and whether you have a subscription or not.

ACPNN

An individual person is responsible for following the process through and it is not a fully automated system yet. Therefore, this individual may/will see all photos uploaded to the ACPNN so please ensure that these photos do not contain anything that might be sensitive in nature to reduce potential security risks and violation of potential agreements. By using the ACPNN, the user understands and agrees that De3ign2Lab’s is at no fault for any incident (legal or otherwise) regarding files provided by the user.

Additionally, the ACPNN is experimental technology. Therefore, by using the ACPNN the user also understands and agrees to not hold De3ign2Lab’s legally responsible if the ACPNN either does not:

  1. provide a result
  2. provides unsatisfactory results.

Personal Information We Collect

We collect your personal information in the course of providing De3ign2Lab’s Services and Products to you. Current collecting of data includes but is not limited to:

  1. Email and Password
  2. File details such as name and size.

Non-Personal Information We Collect

We collect your non-personal information in the course of providing De3ign2Lab’s Services and Products to you. Current collecting of data includes but is not limited to:

  1. Mouse Position and Interaction
  2. Account Storage Amount Used
  3. Account Storage Amount Allowed

We use your personal information to operate, provide, and improve De3ign2Lab’s products. Our purposes for using personal information include:

  1. We use your personal information to measure use of, analyze performance of, fix errors in, provide support for, improve, and develop De3ign2Lab’s products.
  2. We use your personal information to communicate with you in relation to De3ign2Lab via different channels (e.g., by phone, email, chat) and to respond to your requests.
  3. We use your personal information to market and promote De3ign2Lab products and services.
  4. We use your personal information to prevent and detect fraud and abuse in order to protect the security of our customers, De3ign2Labs, and others.
  5. We may also ask for your consent to use your personal information for a specific purpose that we communicate to you.

Location of Personal Information

De3ign2Lab is located in the United States. Depending on the scope of your interactions with De3ign2Lab, your personal information may be stored in or accessed from multiple countries, including the United States. Whenever we transfer personal information to other jurisdictions, we will ensure that the information is transferred in accordance with this Privacy Notice and as permitted by applicable data protection laws.

How We Secure Information

At De3ign2Labs, security is our highest priority. We design our systems with your security and privacy in mind.

We protect the security of your information during transmission to or from De3ign2Labs websites, applications, products, or services by using encryption protocols and software.

We maintain physical, electronic, and procedural safeguards in connection with the collection, storage, and disclosure of personal information. Our security procedures mean that we may request proof of identity before we disclose personal information to you.

Internet Advertising and Third Parties

De3ign2Lab may include third-party advertising and links to other websites and applications. Third party advertising partners may collect information about you when you interact with their content, advertising, or services.

Advertising: If you don’t want to see interest-based ads, please become a subscriber.

Children’s Personal Information

We don’t provide De3ignSketch or De3ign2Lab services for purchase by children.

Retention of Personal Information

We keep your personal information to enable your continued use of De3ign2Labs, for as long as it is required in order to fulfill the relevant purposes described in this agreement, as may be required by law (including for tax and accounting purposes), or as otherwise communicated to you. How long we retain specific personal information varies depending on the purpose for its use, and we will delete your personal information in accordance with applicable law.

Content

All content on De3ign2Labs that you’ve submitted is yours and will remain yours. De3ign2Labs simply stores the information.

Early Development Notice

Please note that De3ignSketch is just beginning and is running a very small team. As we move through early development there will be bugs and issues, as to be expected. We will do our best to ensure your data stays secure and that bugs and issues are taken care of in a timely manner. Not all issues are fixable and some requests may be unreasonable. De3ign2Labs reserves the right to terminate any account for any reason and to refuse to fix issues or bugs. We will update this agreement in the future to create more, well-defined rules concerning termination and other applicable agreements and restrictions.
